OF SALE
ARTICLE I. AGREEMENT
made this ___ th day of __________ , 20 __ , in Lucerne Valley, CA, by
the laws of the County of San Bernardino, State of California, between
Dixie Hirsch of SUNSTAG(Reg.) IRISH WOLFHOUNDS (Breeder) and _________________ (Buyer)
whereby title to a Male/Female Irish Wolfhound (known as: Sunstag
__________________________) , whelped on the ___ th day of
____________ , 20____, by Sire: ____________________________, out of Dam: __________________________________,
and now owned by the Breeder, will vest in the Buyer and the
Breeder will deliver to the Buyer the duly completed AKC
registration form, health records and Breeder's three-generation
pedigree on this hound.

2) ALL TRANSPORT COSTS PAID BY THE BUYER
(including crate and document fees).
3) NO LIABILITIES WILL ACCRUE TO SUNSTAG (Reg.) AFTER DOG LEAVES BREEDER.
ARTICLE II. BREEDER ATTESTS THAT:
1) Hound is certified sound at time of sale.
2) If this hound manifests a hereditary defect affecting said soundness by age 10 months,
Breeder will allow up to 50 percent discount on replacement hound
provided hound in question is neutered. If hound in
question is returned to Breeder intact, there is a full
replacement at earliest availability. ONLY those defects
certified by two (2) veterinarians (one veterinarian of Breeder's
choice) as hereditary are covered under this
Article.
3) THERE ARE NO CASH REFUNDS.
ARTICLE III. BUYER WILL:
1) Pay $ ______________ for this hound, which includes
the Transferrable Reservation Fee of 1/3rd the total, any balance
due for services, plus, if required: transportation (air-$500 to $600), crate costs ($100-$250), Health Certificate ($65), and comply with other
Terms and Conditions as listed herein.
2) Have this hound checked by a veterinarian of
Buyer's choice within 72 hours. Hound should be Microchipped
by your Vet during this visit. A record of that visit should be
made available to the Breeder. No shot combinations or other medications shall
be given in conjunction with the Rabies inoculation.
3) Understand the
importance of continued communication with Breeder and that discussions of the
terms and arrangements pertaining to this contract with any outside individual
or group without consent of Breeder will constitute a Breach of Contract (see
Section 8 below); and, Buyer will endeavor to keep Breeder informed regularly of
progress and condition of this hound: health, growth, temperament, anecdotes,
photos, etc.
4) Understand that this hound is represented to be
a COMPANION and as such may not be shown in conformation
or bred. Hound may participate in Obedience, Lure Coursing
Trials, CGC, Therapy, and/or other AKC performance events, and will be an
in-house family member.
5) SPAY/NEUTER this hound no sooner than age
14 months (unless for a life threatening condition) nor over 25
months of age. At that time, hound should have either
Preliminary (before age 2) or Full Hip X-rays taken for
evaluation. Verification of Neuter to be sent to SUNSTAG(Reg.). Also,
that to spay/neuter before or after the timeframe indicated will constitute
Breach of Contract; as such Article 8 Indemnity shall apply.
6) Not transfer full or co-ownership of this hound
to any other party either for sale, gift, will, as loan payment
or otherwise, except to the Breeder who has first rights to the
return of this hound. (See Article II, Section 3.)
7) Consider membership in one (or more) of the
Irish Wolfhound breed clubs in Buyer's area for the purpose of
continuing the breed education process begun by Breeder. Active
participation in the club is not required.
8) Understand that in the event of Buyer's
inability or unwillingness to maintain said hound, Buyer's death
or catastrophic illness, or obvious abuse of hound by Buyer,
Buyer's family or Buyer's Agent, this contract becomes the
instrument by which the Breeder may reclaim this hound and related
documents and to institute proceedings for damages in the
amount of $7,5000.00 plus reasonable attorney fees,
transportation costs, etc., due to harm done to this hound, the
name of Breeder, the Kennel, and/or the Irish Wolfhound breed, in
general; this article includes Accidental Breeding as a Breach of
Contract.
